§ 1 Scope of Application

The following General Terms and Conditions in the version valid at the time of the order apply exclusively to the business relationship between CurateShift (hereinafter "Seller") and the customer (hereinafter "Customer"). Deviating conditions of the customer are not recognized unless the Seller expressly agrees to their validity in writing.

§ 2 Conclusion of Contract

(1) The presentation of products in the online shop does not constitute a legally binding offer, but an invitation to order. (2) By clicking the "Buy" button, you place a binding order for the goods contained in the shopping cart. (3) The purchase contract is concluded when we accept your order by sending an order confirmation via email immediately after receiving your order.

§ 3 Prices and Payment

(1) The prices mentioned on the product pages include the statutory value-added tax (VAT) and other price components. (2) The customer can make payment by credit card, PayPal, or other methods offered in the shop. (3) Payment is due immediately upon conclusion of the contract.

§ 4 Delivery and Transfer of Risk

(1) Delivery takes place within the delivery times specified on the product page (usually 3–5 business days within Germany). (2) The seller bears the shipping risk. The risk of accidental loss and accidental deterioration of the sold item only passes to the buyer upon delivery of the goods to the buyer (according to § 474 para. 2 BGB).

§ 5 Retention of Title

The goods remain the property of CurateShift until full payment has been made.

§ 6 Right of Withdrawal

Consumers are entitled to the statutory right of withdrawal. Detailed information can be found in our Cancellation Policy.

§ 7 Warranty and Liability for Defects

(1) Statutory liability for defects applies. (2) Should the delivered goods have a defect, the customer has the right to supplementary performance, reduction, or withdrawal from the contract within the framework of legal provisions. (3) For complaints, we ask the customer to contact our support at support@curateshift.com

§ 8 Liability

(1) We are always liable without limitation for claims based on damage caused by us, our legal representatives, or agents:

in case of injury to life, body, or health,

in case of intentional or grossly negligent breach of duty,

in case of warranty promises, if agreed,

as far as the scope of the Product Liability Act is opened. (2) In the event of a breach of essential contractual obligations, the fulfillment of which enables the proper execution of the contract in the first place, liability in the case of slight negligence is limited to the foreseeable damage typical for the contract. (3) Otherwise, claims for damages are excluded.

§ 9 Dispute Resolution

The European Commission provides a platform for online dispute resolution (ODR), which you can find here: https://ec.europa.eu/consumers/odr/. We are not willing and not obliged to participate in dispute resolution proceedings before a consumer arbitration board.

§ 10 Final Provisions

(1) The law of the Federal Republic of Germany applies to contracts between the seller and the customer, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). (2) The contract remains binding in its remaining parts even if individual points are legally ineffective.
